Voidable
Capable of being pronounced void by a party to the transaction, or by a court or tribunal, but not to be treated as a nullity until such action has been taken. Until it is pronounced as void, a voidable contract remains valid.
The term ‘voidable’ is therefore more liberal than ‘void’ and gives the parties to the voidable contract or legal instrument more options.
Instances which may give rise to a contract being deemed voidable include undue influence and misrepresentation.
