Uberrimae fidei
A legal doctrine meaning ‘utmost good faith’. An uberrimae fidei contract imposes an obligation upon the parties to the contract requiring absolute disclosure of all relevant particulars, both at the time of the commencement of the contract and during its term.
Uberrimae fidei applies most notably to insurance contracts, where non-disclosure of material facts may result in the purchaser of the insurance not being covered by their policy.
Uberrimae fidei can be contrasted to the free market doctrine of ‘caveat emptor’ (let the buyer beware). Where uberrimae fidei applies, it operates to protect buyers and sellers to ensure that omissions and/or misrepresentations do not induce entry into the contract or unjustly advantage one party.
